Terms of Service

1. Who we are

These Terms govern your use of Framix (the "Service"), operated by:

By installing or using Framix, you agree to these Terms.

These Terms apply to both consumers (Verbraucher, § 13 BGB) and business customers (Unternehmer, § 14 BGB). Where a clause applies only to one group, it says so.

2. What Framix does

Framix is a plugin and backend that syncs a Wix Stores product catalog (products, images, prices, variants) into Framer's CMS, so you can design your storefront in Framer. Checkout, payments, orders, customers and inventory remain with Wix. Framix reads your catalog; it does not process payments and does not replace your Wix store.

Framix depends on third parties (Wix, Framer, Polar) that we do not control.

3. Accounts

You log in by email (one-time code). You are responsible for keeping access to your email secure and for activity under your account. You must have your own valid Wix and Framer accounts; their terms apply separately.

4. Plans, fees and billing (via Polar)

Framix offers Starter (free), Growth and Ultra plans, billed monthly or yearly. Prices are shown at useframix.com.

Payments are processed by Polar as Merchant of Record. This means Polar is the seller of record for your purchase: Polar collects payment, handles VAT/taxes and invoicing, and the purchase contract for the paid plan is concluded with Polar under Polar's terms. These Framix Terms govern your use of the Service itself.

Paid features are available while your subscription is active and paid.

5. Term, cancellation and refunds

You can cancel at any time; your paid plan then runs until the end of the current billing period, after which it is not renewed. Downgrades take effect at the end of the period.

Refunds and any statutory right of withdrawal for the purchase are handled by Polar under its terms and applicable consumer law.

• Consumers (§ 13 BGB): you have a statutory 14-day right of withdrawal for the purchase, exercised via Polar. Because Framix is a digital service provided immediately, this right lapses once provision begins with your express consent and your acknowledgement that you thereby lose the right of withdrawal.

• Business customers (§ 14 BGB): no statutory right of withdrawal applies.

Verify the exact withdrawal / refund wording with Polar's MoR terms and a lawyer.

6. Acceptable use

You agree not to:

• use the Service unlawfully or in breach of Wix's, Framer's or Polar's terms;

• exceed plan limits, circumvent rate limits, or abuse the sync endpoints;

• reverse engineer, resell, or copy the Service except as permitted by mandatory law;

• use the Service to process data you have no right to process.

We may suspend access for serious or repeated breaches, or for non-payment.

7. Your responsibilities and your store

You are responsible for your own store, its content, product data, pricing, and for your store's own legal compliance (its imprint, privacy policy, consumer information, taxes). Framix mirrors your catalog; it does not make your storefront legally compliant for you.

8. Data protection

We process personal data as described in our Privacy Policy. For the product/store data you sync, you remain responsible as controller; Framix acts on your instructions. A data processing agreement is available on request.

9. Availability

We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. Maintenance, third-party outages (Wix, Framer, Polar, Cloudflare, Vercel) and force majeure are outside our control.

10. Intellectual property

Framix, its software, plugin and brand remain our property (or that of our licensors). We grant you a limited, non-exclusive, non-transferable right to use the Service while your account is active. You keep all rights to your own content and store data.

11. Warranty and liability

The Service is provided "as is" to the extent permitted by law.

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where mandatory law (e.g. Produkthaftungsgesetz) requires. For slight negligence we are liable only for breach of essential contractual obligations ("Kardinalpflichten") and only up to the foreseeable, typical damage. Any further liability is excluded.

This clause must be reviewed by a lawyer for B2C/B2B and §§ 309 BGB conformity.

12. Changes

We may change the Service or these Terms. Material changes will be announced (email or in-product) with reasonable notice. Continued use after changes take effect means acceptance; if you disagree, you may cancel.

13. Governing law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection law of your country of residence remains unaffected. If you are a merchant (Kaufmann), legal entity under public law, or special public-law fund, the place of jurisdiction is Augsburg.

14. Severability

If any provision is or becomes invalid, the remaining provisions stay in force.
